1.1 The purpose of this Trust Deed is to establish a common trust framework governing the custody and administration of trustee-custodied Wallet Accounts throughout the Dataswyft Network.
1.2 This Trust Deed establishes:
(a) the Trust Property;
(b) the relationship between Trustees and Beneficiaries;
(c) the duties, powers and obligations of Trustees;
(d) the rights and beneficial interests of Beneficiaries in relation to trustee-custodied Wallet Accounts; and
(e) the constitutional framework for trustee custody within the Dataswyft Network.
1.3 This Trust Deed applies to every trustee-custodied Wallet Account established by a Network Licensee under the Dataswyft Network Constitution.
1.4 This Trust Deed does not apply to Personal Data Accounts or other data held under a self-custody model except where expressly provided.
2.1 This Trust Deed is a constitutional instrument of the Dataswyft Network and forms part of the Dataswyft Network Governance Stack.
2.2 Every Network Licensee appointed under the Dataswyft Network Constitution shall act as Trustee of the Trust Property established within its jurisdiction in accordance with this Trust Deed. Acceptance of appointment as a Network Licensee constitutes acceptance of the duties and obligations of a Trustee under this Trust Deed.
2.3 The Trustee shall hold the Trust Property solely for the purpose of administering this Trust and trustee-custodied Wallet Accounts in accordance with this Trust Deed and the Dataswyft Wallet Protocol for the benefit of the relevant Beneficiaries.
2.4 This Trust Deed shall be read together with:
(a) the Exclusive Dataswyft Network Operation Licence;
(b) the Dataswyft Network Constitution;
(c) the Dataswyft Wallet Protocol;
