This Dataswyft Wallet Trust Deed (“Trust Deed”) establishes the trust arrangements governing the custody and administration of trustee-custodied wallet records within the Dataswyft Network.

This Trust Deed applies to Dataswyft Wallet services provided through applications that embed the Dataswyft Wallet, including the CheckD application, and other services operating within the Dataswyft Network.

1. Definitions

In this Trust Deed:

“Beneficiary”

means a user of a Dataswyft Wallet who holds rights in relation to data associated with their Wallet Account.

“Country Network Licensee” or “CNL”

means an entity licensed to operate Dataswyft Network services within a jurisdiction and acting as Settlor and Trustee under this Trust Deed.

Where no Country Network Licensee has been appointed for a jurisdiction, Dataswyft Sdn Bhd may act as the default trustee and network operator until a Country Network Licensee is appointed.

“Dataswyft One Platform”

means the technical platform that operates the infrastructure for Dataswyft Wallet Accounts and HAT Microserver databases.

“Dataswyft Jurisdiction Wallet Database”

means the database infrastructure operated by the Trustee within a jurisdiction for maintaining and administering trustee-custodied wallet records associated with Dataswyft Wallet Accounts.

“HAT Microserver”

means a personal data infrastructure within the Dataswyft ecosystem that hosts Personal Data Accounts controlled by users.

“Personal Data Account” or “PDA”

means a namespace of folders within a HAT Microserver database used by a Beneficiary to store and manage data under their direct control.

“Protector”

means the HAT Community Foundation, which oversees the trust arrangements established under this Trust Deed.
