This Dataswyft Wallet User Agreement (“Agreement”) governs your use of the Dataswyft Wallet and your participation in the Dataswyft Network through your Wallet Account.
By creating, activating or using a Dataswyft Wallet, you agree to be bound by this Agreement.
This Agreement is entered into between:
(a) you, whether acting in your personal capacity or as an authorised representative of a legal person (the “Wallet User” or “you”); and
(b) Dataswyft Network Ltd, a company incorporated in England and Wales (Company No. 15059243) whose registered office is at 75 Ermine Way, Arrington, Royston, England, SG8 0AG, acting in its capacity as the Network Licensee for the Dataswyft Wallet made available through the CheckD application (the “Network Licensee”).
The Dataswyft Wallet is made available to you through the CheckD application, which is operated by Dataswyft Network Ltd.
The CheckD application and the Dataswyft Wallet are related but separate services.
Your use of the CheckD application and its features is governed by the applicable CheckD Terms of Service.
This Agreement governs only your use of the Dataswyft Wallet, your Wallet Account and your participation in the Dataswyft Network.
Dataswyft Network Ltd, acting as the Network Licensee, is responsible for establishing and maintaining your Wallet Account, including the custody of your Wallet Account in accordance with the applicable custody model.
For Wallet Accounts established through CheckD, the jurisdiction of your Wallet Account is Malaysia. Your Wallet Account is established, custodied and administered under the laws of Malaysia, unless otherwise expressly notified by the Network Licensee.
The Dataswyft Network is governed by TruSignal Assets Ltd, acting as the Network Operator, in accordance with the Dataswyft Network Constitution and the Dataswyft Wallet Protocol.
The Network Operator establishes the constitutional and technical framework governing the Dataswyft Network but is not a party to this Agreement.
